1. Acceptance of Terms

By accessing and using GitGuessr ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you and GitGuessr.

2. Description of Service

GitGuessr is a code-guessing game where players are shown code snippets from public GitHub repositories with certain lines masked. Players browse the repository to understand context and guess the missing code. The Service is provided for educational and entertainment purposes.

3. Account and Authentication

To use GitGuessr, you must authenticate using your GitHub account. By doing so:

• You authorize us to access your GitHub profile information (username, display name, avatar, and email address) to personalize your experience and communicate with you
• You confirm that you are at least 13 years of age or the minimum age required in your jurisdiction to use online services
• You are responsible for maintaining the security of your GitHub account
• You agree to maintain only one GitGuessr account per person

We do not access your private repositories, modify your GitHub account, or store your GitHub credentials.

4. Acceptable Use

You agree to use GitGuessr only for lawful purposes, including:

• Educational purposes and learning about code
• Entertainment and recreational gameplay
• Personal skill development and practice
• Friendly competition with others

5. Prohibited Activities

You agree not to engage in any of the following:

• Using automated tools, scripts, or bots to play the game or interact with the Service
• Cheating by using external tools to look up answers during gameplay
• Attempting to exploit, hack, or probe for vulnerabilities in the Service
• Interfering with or disrupting the Service or its infrastructure
• Circumventing any access controls or usage limits
• Impersonating others or creating fake accounts
• Using the Service in any way that violates applicable laws or regulations
• Harassing, abusing, or threatening other users
• Submitting inappropriate, offensive, or abusive content in map names, descriptions, or other user-generated content

6. Intellectual Property

The code displayed in GitGuessr comes from public GitHub repositories and remains the property of its respective owners, subject to their original licenses. GitGuessr does not claim ownership of any third-party code displayed through the Service.

The GitGuessr name, logo, game mechanics, user interface, and original content are proprietary and protected by intellectual property laws. You may not copy, reproduce, or create derivative works based on GitGuessr without prior written permission.

7. User Data and Privacy

When you use GitGuessr, we collect and store:

• Your GitHub profile information (username, display name, avatar URL, and email address)
• Your game history, scores, and statistics

We use this data to provide and improve the Service. We do not sell your personal information to third parties. We retain your data for as long as your account is active. If you delete your account, we will delete your personal information within 30 days, except where we are required to retain it for legal purposes or to prevent abuse. 8. Third-Party Content and Services

GitGuessr uses GitHub for authentication. Your use of GitHub is subject to GitHub's own Terms of Service and Privacy Policy.

The code displayed during gameplay is sourced from public GitHub repositories. This code remains the property of its original authors and is subject to its original license terms. We are not responsible for the accuracy or quality of third-party code displayed through the Service.

We use OpenAI's content moderation service to automatically screen user-generated content (such as map names and descriptions) for potentially harmful or inappropriate material. This content may be sent to OpenAI for analysis. OpenAI's use of this data is subject to their Privacy Policy.

9. Disclaimer of Warranties

GitGuessr is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. We make no warranties regarding the accuracy, reliability, or completeness of any content, including code displayed from third-party repositories. Game content may be added, modified, or removed at any time without notice.

10. Indemnification

You agree to indemnify, defend, and hold harmless GitGuessr and its operators, affiliates, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

11. Limitation of Liability

To the maximum extent permitted by law, GitGuessr and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, but is not limited to, damages for loss of profits, data, or other intangible losses. Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to use the Service (if any) in the twelve months preceding the claim.

12. Scores and Leaderboards

Game scores, statistics, and leaderboard rankings are provided for entertainment purposes only. We reserve the right to reset, adjust, or remove scores and leaderboard data at any time, for any reason, including but not limited to suspected cheating, technical issues, or service updates. You have no ownership rights or entitlement to any scores, rankings, or achievements within the Service.

13. Account Termination

We reserve the right to suspend or terminate your access to GitGuessr at any time, with or without cause, including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Conduct that harms other users or the Service

You may delete your account at any time by contacting us or using account management features if available.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in accordance with applicable law.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.
